Recycle Radio Terms of Use

These terms are an agreement between you and [OWNER NAME] ("we", "us"), the developer of Radio Bot. They apply to the Recycle Radio app, the Recycle Radio server software, and, once it's available, the Recycle Radio Cloud service (paid plans). By installing or using any of them you agree to these terms. If you don't agree, don't use Recycle Radio.
Our Privacy Policy, Acceptable Use Policy and Copyright Policy are part of these terms.
1. Who can use Recycle Radio
You must be at least 18 years old, or the age of majority where you live if that is higher. If you use Recycle Radio for a business, you confirm you're allowed to accept these terms for it.
2. What Recycle Radio is, and what it isn't
Recycle Radio is a radio and podcast player. It can also use a Recycle Radio server (one you run, or Recycle Radio Cloud) to turn what's said on air into text and tell you when words you chose, or what looks like a contest, come up.
Recycle Radio is independent. It is not affiliated with, endorsed by or sponsored by any radio station, broadcaster, podcast, record label, Apple, Google, Radio Browser or any other company whose content or services it shows. Station names, logos and other trademarks belong to their owners and are shown only to identify the stations.
3. Stations, podcasts and other content
The stations, podcasts, song information, album art and lyrics you find in Recycle Radio come from their owners and from third-party directories. We don't own, host or control them. When you listen, the audio comes straight from the station or podcast to your device; Recycle Radio never relays it.
- Content may be unavailable, change, stop or move without notice, and it may be unsuitable for some listeners.
- The owners' own terms may apply to their content. You're responsible for following them.
- Don't use Recycle Radio to get around a station's geographic restrictions, paywall, login or other access control.
4. Contest alerts
Alerts are a heads-up only. We don't run, sponsor or have any part in any contest, and we can't promise that an alert is correct, complete or on time. Speech-to-text makes mistakes, streams run behind the air, and connections drop.
- Each contest has its own rules, set by the station or sponsor. You must follow them. Some contests don't allow automated help; it's up to you to check before you take part.
- Recycle Radio never calls or texts a station for you. Tapping a number opens your phone's dialer or messages app, and you decide whether to call or text. Your carrier's usual rates apply.
- Phone numbers, weather, gas prices and other details picked up from broadcasts can be wrong. Check them before relying on them.
- Prizes, eligibility and disputes are between you and the contest's organizer.
5. Rewind, recordings and clips
Rewind, recordings and saved clips are for your own private listening later. You may not share, upload, sell, broadcast or publicly play them, or use them to build a collection of music. They stay in the app, are encrypted, and can't be played anywhere else.
- In the Google Play version, a saved clip is up to 60 seconds long and is deleted automatically after 30 days.
- Recording may not be allowed for every station or in every country. You're responsible for using it only where it's allowed.
6. Lyrics, album art and song information
Lyrics, album art and song details come from third-party services and their licensors, for your personal use while listening. Album art from Apple is shown with a link to the song on Apple Music. Some Apple Music links are affiliate links: if you buy or subscribe after following one, we may earn a commission, at no cost to you.
7. Streams you add or submit
You can add stream addresses yourself. When you do, you confirm that the stream is publicly available from its owner, or that you're allowed to use it, and that it follows our Acceptable Use Policy.
You give us permission to check the address, store it, and, if you share it with a Recycle Radio server we run, to keep it and (after our review) offer it to other Recycle Radio users. We may refuse, change or remove any stream at any time.
8. Your own Recycle Radio server
If you run the Recycle Radio server software yourself, you're responsible for it: the computer it runs on, the stations you monitor with it, the services and keys you connect it to (for example Groq, OpenAI, Discord or Firebase), the data it keeps, and following the laws and terms that apply to recording and transcribing those stations. We don't receive anything from your server.
9. Recycle Radio Cloud and paid plans
This section applies once Recycle Radio Cloud is available.
- Account. You sign in with your Google account. Keep access to it secure; you're responsible for what happens under your account. One account is for one person.
- Subscriptions. Paid plans are sold through Google Play and billed by Google to the payment method on your Google account. The price, currency, billing period and what the plan includes are shown before you buy. Taxes may be added.
- Renewal. A subscription renews automatically at the end of each period until you cancel.
- Cancelling. Cancel any time in the Google Play Store (Payments & subscriptions › Subscriptions). You keep your plan until the end of the period you've paid for. Deleting the app or your Recycle Radio account doesn't cancel a Google Play subscription.
- Refunds. Refunds are handled under Google Play's refund policies and the consumer laws that apply to you. Contact us if something went wrong and we'll help.
- Free trials. If a plan has a free trial, it turns into a paid subscription at the end of the trial unless you cancel before then.
- Price changes. We'll tell you before a price change applies to you, as Google Play and the law require, and you can cancel before it does.
- Limits. Plans include a number of stations and keywords and are meant for one person's normal use. We may limit use that puts the service at risk or costs far beyond a plan's normal use, and we'll tell you if we do.
- Changes to the service. We may add, change or remove stations and features. If we remove something central to a plan you've paid for, you may cancel and ask for a prorated refund of the unused part.
10. Rules for using Recycle Radio
Follow our Acceptable Use Policy. In short: use Recycle Radio lawfully and for your own listening, don't misuse or overload it, and don't use it to copy or republish what stations broadcast.
11. Our software and your licence to use it
Recycle Radio, its code, design and name belong to us (except the parts that belong to others; see the open-source licences). We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Recycle Radio on devices you own or control, under these terms.
You may not copy, sell, rent or sublicense Recycle Radio; remove its notices; reverse engineer it, except where the law allows it despite this limit; or use our name or logo without permission. Open-source parts of Recycle Radio are under their own licences, which win where they conflict with this section.
12. Feedback
If you send us ideas or suggestions, we may use them without owing you anything.
13. Other companies' services
Recycle Radio works with services run by others, such as Google Play, Firebase, Apple, Radio Browser and, if you choose, Groq or OpenAI with your own account. Their terms and privacy policies apply to your use of them, and we're not responsible for them.
14. Changes to Recycle Radio and to these terms
We may update Recycle Radio, and stop offering features or the app itself. We may change these terms; we'll update the effective date and, for important changes, tell you in the app or by email before they take effect. If you keep using Recycle Radio after that, the new terms apply. If you don't agree, stop using Recycle Radio (and cancel any subscription).
15. Ending
You can stop using Recycle Radio at any time and delete your data as described in Delete your data. We may suspend or end your access if you break these terms or the law, or to protect the service, other users or the stations. Sections that by their nature should continue (for example 11, 16, 17, 18 and 19) still apply after access ends.
16. No warranty
Recycle Radio is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free or accurate, or that it will catch any particular word, contest or call-in number. Some laws don't allow these exclusions; where they apply, the exclusions apply only as far as allowed.
17. Limits on our liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, lost prizes or opportunities, lost data, or lost profits, arising from Recycle Radio, even if we knew they were possible. Our total liability for any claim about Recycle Radio is limited to the greater of the amount you paid us for Recycle Radio in the 12 months before the claim, or CA$50.
Nothing in these terms limits liability that can't be limited by law, or takes away rights you have under consumer protection laws that can't be waived (including in Quebec).
18. Your responsibility
To the extent the law allows, you'll cover our reasonable costs from claims made by others because you broke these terms or the law, or infringed someone's rights, while using Recycle Radio.
19. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless the consumer protection laws of where you live give you the right to go to your local courts.
20. General
These terms (with the policies they mention) are the whole agreement between you and us about Recycle Radio. If part of them can't be enforced, the rest still applies. If we don't enforce a part right away, we can still enforce it later. You may not transfer these terms; we may transfer them to whoever takes over Recycle Radio.
